Fort Lauderdale Sexual Assault Lawyer

Don’t let a sexual assault conviction ruin your life

In Florida, there is no legal distinction between sexual assault and rape. What does that mean for you, the accused? It means that if you are convicted, you could spend 15 years to life in prison. As the person charged, you are often facing a situation where it is only your word against the accuser’s. And in the case of sexual assault charges, a significant number of false accusations are made. At Kevin J. Kulik, P.A. in Fort Lauderdale, we defend clients in Broward County and beyond who are facing charges of sexual assault or sexual battery. As a criminal defense lawyer with three decades of  experience, Kevin Kulik knows how to craft an effective strategy. Moreover, he understands how the other side thinks, because prior to becoming a criminal defense lawyer, he was an assistant state attorney. Contact our Fort Lauderdale sexual assault lawyers for more information or assistance today.

Because the prosecution may be short on hard evidence, it is even more important to work with an attorney who defends against sex crimes and understands that the public — and the jury — may be predisposed to sympathy toward the “victim.” We are more than up to the challenge. We know how to poke holes in the prosecution’s arguments and convince the jury to see your side of the story.

A question of consent

By definition, sexual assault is any sexual act performed without consent. Under Florida Statute, consent is defined as “intelligent, knowing and voluntary consent, and does not include coerced submission. Consent shall not be deemed or construed to mean the failure of the alleged victim to offer physical resistance to the offender.”

If the accuser was drunk, the sex was not consensual. If the accuser was under the influence of drugs, asleep or passed out, the sex was not consensual.

But what if it is a case of morning-after remorse?

Dealing with the false accusation

False accusations may be made because your accuser woke up thinking, “What did I just do?” Even more unfortunately, they can be the result of a desire for revenge:

  • A relationship gone bad
  • An ex-spouse seeking custody or alimony
  • Even an employee who was denied a raise

Even if you are married, you may still be accused of marital rape. If you have been falsely accused, do not talk to the police. It is all too easy to say the wrong thing when you are upset — and to have anything you said innocently or in a moment of anger used against you. It is in your best interest to get immediate legal representation. As your criminal defense attorneys, we can protect your rights and start building a defense for you.
