Misdemeanor Or Felony?

Even though the distinction between misdemeanor and felony charges matters, most people think a misdemeanor charge should not be given as much thought as a felony charge. This misunderstanding can result in greater sentences, fines and penalties for misdemeanor charges than is otherwise necessary. While the jail time associated with a felony charge is generally greater, a misdemeanor conviction can have lasting repercussions.

The difference between a misdemeanor and a felony is the length jail time associated with conviction of the charge. Both misdemeanors and felonies can carry jail time upon conviction, but the time to serve is less for a misdemeanor. A misdemeanor crime has a sentence of less than one year, while a felony is longer. To minimize the sentence imposed, or to seek outright dismissal of the charges against you, hire an attorney who looks at all possible defenses and vigorously argues your case. Your defense will depend upon the specific and unique facts of your case. Make sure your best defense is put forth by:

  • Immediately calling an attorney upon arrest, so you can be given clear and accurate advice
  • Telling your attorney everything, no matter how insignificant you believe the information
  • Making note of the names and contact information of witnesses, if there were any
  • Taking photos to preserve evidence, when damage to another person or property is involved
